Terms, license and privacy.
Last updated November 4, 2026
The short version
The full text below is the agreement. This summary is here so you know what you are agreeing to before you read it.
- M-ARK is reference software. It is not medical, legal, electrical, structural, survival or safety advice. It does not replace a doctor, an engineer, a lawyer, a trained rescuer or an emergency service. In an emergency, call your local emergency number.
- The library comes from third-party publishers under their own licenses. The AI writes from that library and can be wrong. You check the source before you act, and you are responsible for what you do.
- We are not responsible for your survival, your health or your safety, or anyone else's. M-ARK is a collection of references and tools. Whether you and the people around you come through an emergency depends on your own preparation, judgment, training and circumstances, not on this software.
- The software is sold as is, with no warranty. Our liability is limited to what you paid for it, and we are not liable for injury, loss or damage that results from relying on the software or on content reached through it, to the fullest extent the law allows.
- One license covers the computers in your household, for personal use. No resale, no sharing outside the household, no running a service for others.
- All sales are final. Downloaded software cannot be returned.
- No account, no cloud, no telemetry. Your records stay on your computer.
- Disputes go to individual arbitration or small claims court, not class actions, where the law allows that. You can opt out of arbitration within 30 days of buying.
Terms of sale
1. Who you are dealing with
M-ARK is published by Silverhall LLC, 1209 Mountain Road Pl NE, Ste R, Albuquerque, NM 87110, United States ("we", "us", "the publisher"). Your purchase is made from our reseller and merchant of record, Paddle.com Market Ltd for buyers outside the United States and Paddle.com Inc. for buyers in the United States ("Paddle"). Paddle is the seller of record: it charges your payment method, collects and remits any sales tax or VAT, issues your invoice and handles payment disputes under its own checkout buyer terms. These terms cover the software and your use of it, and they apply between you and us.
2. Who may buy
You must be at least 18 years old, or the age of majority where you live if that is higher, and legally able to enter into a contract. By buying you confirm that you are. If you are buying for a household, you are responsible for everyone in it who uses the software, and you agree to make these terms known to them.
3. What you buy
A license key and the right to download the current version of M-ARK for Mac, Windows and Linux, under the license agreement below. The price shown at checkout is the full price in US dollars. Tax is added at checkout where it applies. Delivery is by email and download within minutes of payment. Because delivery is immediate and the software runs offline, all sales are final, see the refund section.
4. Agreement
You agree to these terms, including the license agreement, the disclaimers, the limitation of liability and the dispute resolution section, when you complete a purchase, when you enter a license key, and when you click "I agree" the first time the app starts. If you do not agree, do not buy, do not install, and do not use the software.
End user license agreement
5. License grant
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use M-ARK on computers owned or controlled by you and the members of your household, for personal, non-commercial purposes, for as long as you comply with these terms. The software is licensed, not sold. We keep all rights not expressly granted.
6. What you may not do
- Sell, rent, lease, lend, sublicense, share or otherwise provide the software or your license key to anyone outside your household.
- Use the software to provide a service to others, in a business, or for any commercial purpose, without a separate written license from us.
- Copy the software except for a reasonable number of backup copies.
- Modify, adapt, translate, decompile, reverse engineer or create derivative works of the software, except to the extent that applicable law expressly allows it despite this term.
- Remove, hide or alter any copyright, trademark, attribution or license notice in the software or in content reached through it.
- Circumvent or disable the license check or any other protection in the software.
- Use the software in any way that breaks the law, infringes anyone's rights, or breaches the license of any third-party content or model it downloads.
- Use the software as a component of, or in connection with, any system where a failure could lead to death, personal injury or severe physical or environmental damage, including medical devices, life support, aircraft, vehicles, nuclear facilities or weapons.
7. Third-party content and models
M-ARK downloads reference content directly from its publishers to your computer, under each publisher's own license. We do not create, host, sell, endorse or verify that content and we are not responsible for it. Wikipedia and Stack Exchange are CC BY-SA, OpenStreetMap is ODbL, GeoNames is CC BY 4.0, and government publications are public domain or under open government licenses. Attributions and license texts are shown in the app. Some collections are for non-commercial use only and are marked as such. Your own documents stay yours and you are responsible for having the right to use them.
The AI models that ship with or can be downloaded into M-ARK are released by their makers under their own licenses (Apache 2.0 for Qwen, the Llama Community License for Llama models, with "Built with Llama" where required). Their license texts are included in the app. The makers of those models are not responsible for how they are used here.
Content and models may contain errors, may be out of date, may be incomplete, and may be withdrawn or changed by their publishers at any time. We do not promise that any collection stays available for download.
8. Updates, support and discontinuation
We may provide updates to the software and to the library index. We are not obliged to provide any particular update, feature or support, and we may stop developing or distributing the software at any time. A copy you have installed keeps working offline whatever happens to us. Support is by email, on a best-effort basis, with no guaranteed response time.
9. Intellectual property
The software, its design, its documentation and the M-ARK name and logo are our property or licensed to us, and are protected by copyright, trademark and other laws. Nothing in these terms transfers any of that to you. Feedback you send us may be used by us without obligation to you.
10. Export control and sanctions
You may not download, use or export the software in violation of United States or other applicable export control and sanctions laws, and you confirm that you are not on any government restricted-party list and not located in a country subject to a comprehensive embargo.
11. Termination
Your license ends automatically if you breach these terms. On termination you must stop using the software and delete all copies. Sections 6 to 18 survive termination. No refund is due on termination for breach.
What M-ARK is not
12. Reference only, not advice
M-ARK is a reference tool. Nothing in the software, in the library it downloads, in the answers its AI writes, in its maps, tides, calculations, schedules, reminders or any other output is medical, health, pharmaceutical, nutritional, legal, financial, electrical, structural, mechanical, chemical, navigational, meteorological, survival or safety advice, and none of it is a substitute for a qualified professional, an official source or an emergency service.
In particular:
- Health. The medical and medicines references are general information. They are not a diagnosis, a prescription or treatment advice for any person. Dosages, interactions and contraindications must be confirmed with a doctor or pharmacist. The medicines, foraging and regional guides included with the software were drafted with the help of AI, are marked as drafts, and have not been reviewed by a doctor, pharmacist, botanist or other professional.
- The AI. Answers are generated by a language model from passages in your library. The model can misread a source, combine sources wrongly, miss a relevant source, or state something with confidence that is false. The numbers it shows are references for you to check, not proof. You must read the cited source before you act on anything that matters, and you must not rely on an answer in an emergency.
- Maps and navigation. Maps, routes, place data, compass fixes and distances come from OpenStreetMap and other third-party data, may be wrong or out of date, and are not for use as the sole means of navigation. Tide and sun tables are computed from astronomy alone, are not corrected for local conditions, and are not for navigation or any safety-critical use.
- Stock, rations and maintenance. Expiry warnings, ration plans, nutrient figures, maintenance schedules and equipment scores are calculated from data you enter and from general reference tables. They do not know the real condition of your food, water, medicines or machines. You remain responsible for inspecting what you store and the equipment you operate.
- Radio, signals and electricity. Radio use is regulated and requires licenses in most countries. Electrical, fuel, generator, firearms and other hazardous activities require training and compliance with local law. The software provides reference text only.
- Emergencies. The software cannot call for help. In an emergency contact your local emergency services.
13. Your responsibility and assumption of risk
Survival, preparedness, outdoor, mechanical, electrical and medical activities carry inherent risks, including serious injury and death. You alone decide whether and how to act on any information reached through the software, and you accept full responsibility for those decisions and their consequences. You agree that you use the software and any content reached through it at your own risk, and that we have no control over how you use it or over the content its publishers provide.
We are not responsible for your survival, health, safety or welfare, or for the survival, health, safety or welfare of any member of your household or any other person, in any emergency, disaster, outage, conflict or other situation, whether or not the software was used, was available, or worked as described. The software does not guarantee, promise or imply that you will survive, stay healthy, stay safe, find food, water, shelter, medicine or help, reach a destination, or keep any equipment running. Any such outcome depends on your own preparation, skills, judgment, resources and circumstances, and on events outside anyone's control. You agree that you do not rely on the software for your survival or safety and that no claim against us may be based on an outcome of that kind.
Warranty and liability
14. No warranty
To the fullest extent permitted by applicable law, the software, the content it downloads, the models it runs and any output are provided "as is" and "as available", with all faults and without warranty of any kind. We disclaim all warranties, express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, currency, reliability, or that the software will be error-free, uninterrupted, secure, or compatible with your computer, your other software or your data. No advice or information, oral or written, obtained from us creates any warranty.
The software is tested on computers that meet the requirements published on the product page. If you are not sure your computer qualifies, write to us before you buy.
15. Limitation of liability
To the fullest extent permitted by applicable law, in no event will we, or the people who work on M-ARK, be liable to you or to anyone else for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of life, failure to survive, personal injury, illness, property damage, loss of data, loss of profits, loss of business, or costs of substitute goods or services, arising out of or related to the software, the content reached through it, its output, its unavailability, or these terms, whether in contract, tort (including negligence), strict liability, product liability or any other legal theory, even if we were told that such damages were possible.
To the fullest extent permitted by applicable law, our total aggregate liability to you for all claims arising out of or related to the software or these terms will not exceed the amount you paid for the license in the twelve months before the claim arose, or fifty US dollars, whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for death or personal injury caused by negligence, for fraud, or for certain consumer losses. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under the law that applies to you, and in those jurisdictions our liability is limited to the greatest extent the law permits. If you are a consumer in the European Union or the United Kingdom, nothing here takes away your statutory rights.
16. Indemnity
To the extent permitted by law, you agree to defend, indemnify and hold harmless us and the people who work on M-ARK from any claim, loss, liability, damage, cost or expense, including reasonable legal fees, arising out of your use of the software or of content reached through it, your breach of these terms, your breach of any third-party license, or your violation of any law or of anyone's rights.
17. Release
To the extent permitted by law, you release us from all claims, demands and damages of every kind, known or unknown, arising out of or in any way connected with your use of the software or with any decision or action you take based on content reached through it. If you are a California resident, you waive California Civil Code section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
Disputes and general terms
18. Governing law
These terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law rules, except that mandatory consumer protection law of the country where you habitually live continues to apply to you if it gives you more protection. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
19. Arbitration and class action waiver (United States)
If you live in the United States, you and we agree to resolve any dispute arising out of or relating to the software or these terms by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court, and either party may seek an injunction in court to protect intellectual property. The Federal Arbitration Act governs this section. The arbitration takes place in the county where you live, or by video or on documents only. We will pay the arbitration filing fees for any claim of under ten thousand US dollars unless the arbitrator finds the claim frivolous.
You and we each waive the right to a jury trial and the right to take part in a class action, collective action or representative proceeding. Disputes are resolved only on an individual basis.
You may opt out of this arbitration section by emailing us within 30 days of your purchase with your name, your order email and a clear statement that you opt out. Opting out does not affect the rest of these terms. If the class action waiver is found unenforceable for a particular claim, the arbitration agreement does not apply to that claim and it is heard in court.
20. Courts outside the United States
If you live outside the United States, disputes are brought in the courts of the State of New Mexico, United States, unless the mandatory law where you live gives you the right to bring them in your local courts. If you are a consumer in the European Union you may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged to take part in alternative dispute resolution procedures before consumer arbitration boards.
21. Time limit on claims
To the extent permitted by law, any claim arising out of the software or these terms must be brought within one year after it arises, or it is permanently barred.
22. Changes to these terms
We may update these terms. The date at the top shows the current version. Changes apply to purchases made after the change. For a license you already hold, the terms you accepted at purchase continue to apply unless you accept the new ones in the app.
23. General
These terms, together with Paddle's checkout terms for the payment and the third-party licenses for content and models, are the entire agreement between you and us about the software. If any part of these terms is held unenforceable, the rest remains in force and the unenforceable part is enforced to the greatest extent the law allows. Our failure to enforce a term is not a waiver of it. You may not assign your license or these terms. We may assign them to a successor of the M-ARK business. Headings are for convenience only. Nothing in these terms creates a partnership, agency or employment relationship.
Privacy
The short version: M-ARK has no account, no cloud and no telemetry. Your records stay on your computer.
The app
M-ARK runs on your own computer. Your questions, answers, journal, people, stock, equipment, places and reminders are stored in a folder on your disk or drive and are never sent to us. The AI runs on your processor. The app connects to the internet only when you ask it to: to download the app and your library from the publishers, to check for updates, to search the web in RESEARCH if you switch that on, or to download a model from Hugging Face. OFFLINE MODE blocks all of it with one switch.
When the app downloads content, the publisher's server sees your IP address, as with any download. We do not see it. The app does not send crash reports, usage statistics or identifiers to anyone. Your license key contains the email address you bought with, so that the key is yours, and the app reads it locally only.
Buying
When you buy, Paddle collects your email address, your country and your payment details to process the payment, collect tax and issue your invoice. Paddle's privacy policy covers that. We receive your email address, your country and your order id so we can issue your license key, answer support questions and tell you about updates. We keep that record for as long as your license exists and as long as tax law requires. We do not sell or rent your address, and you can ask us to delete it at any time by writing to the contact address below. Your license stays valid.
This website
This site sets no cookies of its own and runs no analytics or advertising scripts. Fonts are loaded from Google Fonts, which sees your IP address when the page loads. The checkout is run by Paddle inside this page and on Paddle's own domain, under Paddle's cookie and privacy terms.
Your rights
You can ask us what we hold about you, ask us to correct or delete it, object to its use, and complain to your data protection authority. Write to the address below and we answer within 30 days. If you are in the European Economic Area or the United Kingdom, the legal basis for holding your order record is the contract with you and our legal obligations.
Refunds
All sales are final. M-ARK is downloaded software that runs offline, so once the app and the license key are delivered they cannot be returned, and we have no way to confirm that a copy has been deleted. For that reason we do not offer refunds.
Before you buy, read the requirements on the product page and the "What M-ARK is not" section above. If you are unsure whether your computer qualifies, or whether M-ARK does what you need, write to us first and we will answer honestly, including when M-ARK is not for you.
If you live in the European Union, the United Kingdom or another place with a statutory cooling-off period for online purchases of digital content, you will be asked at checkout to agree that delivery starts immediately and that you lose your right to withdraw once it has. Without that agreement the purchase cannot complete. Where the law gives you a non-waivable remedy for digital content that does not conform to the contract, that remedy is unaffected.
Paddle, as merchant of record, applies this policy and handles any payment dispute under its own terms.
